In North Carolina, a contractor or materialman must file its lien within 120 days of the date on which it last provide labor or materials. In South Carolina, the lien must not only be filed within 90 days, but served within 90 days. Furthermore, it is important to recognize that 120 days does not mean four months! Any mistakes in preparing, filing or (in the case of South Carolina lien disputes) serving a lien can render it null and void.
